Horse and You General and Purchase Terms
1. Validity of the General Terms and Conditions
1.1. These general and purchase terms apply to all individuals (hereinafter referred to as the CUSTOMER) and to the relationship between the online store www.horseandyou.com, owned by Horse and You OÜ (hereinafter Horse and You), located at Kadakamarja Street 1, Saue Town, Harju County 76505, Estonia, reg. no. 16793741, and the purchase of products through Horse and You's online store.
1.2. In addition to these terms, the legal relationships arising from purchasing products through the Horse and You online store are governed by the applicable laws of the Republic of Estonia and the European Union.
1.3. Horse and You is entitled to modify and supplement these terms and price lists without prior notice due to the development of the online store and in the interest of better and safer usage. Changes or additions to the terms and price lists will be communicated through the www.horseandyou.com website and will come into effect as soon as they are published on the www.horseandyou.com page. If the CUSTOMER placed their order before the changes to the terms take effect, the terms that were in effect at the time of the order will apply to the legal relationship between the CUSTOMER and Horse and You, unless otherwise provided by law or these terms.
2. Prices
2.1. The prices displayed on the Horse and You online store are in euros.
2.2. All prices include VAT.
3. Shopping Cart and Order Placement
3.1. The CUSTOMER's shopping cart is created when the CUSTOMER adds a product to the cart.
3.2. The quantity of products in the shopping cart can be changed by the CUSTOMER at any time on the shopping cart page.
3.3. The CUSTOMER can enter a discount code in the "Discount Code" field on the shopping cart page, which will apply the corresponding discount. The discount provided by the discount code does not apply to products already on sale, unless specified otherwise in the promotion.
3.4. The sales contract for the products is considered concluded (Contract coming into effect) from the moment when payment for the order has been made or an installment or payment plan agreement has been arranged (with the service provider offering financing via the online store). If paid in advance, the contract is considered concluded once a confirmation letter about the acceptance of the order is sent to the CUSTOMER's email address.
4. Payment for Products
4.1. There are several payment options for products in the Horse and You online store:
1) Payment can be made in the shopping cart via a bank link, credit card, by signing an installment agreement, or by paying in installments. Bank links are provided, and payment services are facilitated by Montonio Finance UAB.
2) Payment can also be made via a prepayment invoice. In this case, a prepayment invoice will be sent to the CUSTOMER's email address, and it must be paid via bank transfer to the bank account specified on the invoice before the goods are dispatched.
5. Order Fulfillment and Product Delivery
5.1. Products marked as "In Stock" (this label is located next to the product description in the online store) will be delivered to the shipping company within 1-5 business days, usually the next business day, unless you prefer to pick up the products yourself.
5.2. 5.2. Products with a specified delivery time (this information is located next to the product description in the online store) are ordered by Horse and You from the manufacturer or a partner warehouse. The fulfillment deadline for these products will be specified separately for each order and product. The delivery time depends on the specific product and its availability. Typically, fulfillment takes 7-14 days, but in exceptional cases, it may take up to 30 days. Once these products arrive at the Horse and You warehouse, they will be delivered under the same conditions as "In Stock" products, as outlined in Section 5.1 of these Terms.
6. Product Delivery
6.1. After the Agreement comes into effect as per Section 3.4 of these Terms, and once Horse and You has dispatched the products, the products will be delivered by the shipping company (Venipak AS, Omniva AS, or Itella Estonia OÜ), unless the Customer opts to pick up the products personally. The products will be delivered to the address selected in the Order at the time of purchase, either to a parcel machine or by courier. Changing the destination or parcel machine after the order has been handed over to the shipping company depends on the specific circumstances and may not always be possible. This service is subject to an additional charge of 5 euros per order.
6.2. The products, along with product information and any accompanying documents, will be delivered to the Customer's chosen address within the time frame specified by the shipping company, typically within 24 hours and no later than 3 business days. Horse and You does not guarantee delivery times and is not responsible for any delays or issues caused by the shipping company.
6.3. Horse and You and the shipping company are not responsible for delivery delays or misunderstandings if the delay or issue is due to inaccurate or incorrect information provided by the Customer during the order process.
6.4. The Customer will be notified by SMS and/or email when the shipment arrives at the parcel machine, using the contact information provided in the order. In the case of courier delivery, the Customer will generally be contacted by SMS or phone beforehand to confirm the delivery time.
6.5. The shipment will be handed over to the Customer by the courier with the shipping document. Before accepting the shipment, the Customer must inspect the package for any external damage. If damage is found, the Customer must inform the courier and immediately notify Horse and You about the damaged package via email at info@horseandyou.com.
6.6. Orders over 100 euros (including VAT) will be delivered to a parcel machine free of charge! If the ordered products do not fit in the parcel machine, they will be sent to the address provided by the Customer via courier, with the delivery charge as shown in the shopping cart.
7. Order Cancellation and Product Return
7.1. The Customer has the right to cancel their order before the products are dispatched by sending a notice to Horse and You via email at info@horseandyou.com, specifying the order number.
7.2. After receiving the products, the Customer has 30 days to inspect the items. If the purchased product is unsuitable for the Customer for any reason, the Customer has the right to return or exchange it for another product within 30 days by sending a return request via email to info@horseandyou.com, including the order number.
7.3. In the case of cancellation as described in Section 7.1 or withdrawal as outlined in Section 7.2, the Customer will receive a refund for the price of the returned products. The delivery cost will be refunded only if the return is due to a defective product or an error on the part of Horse and You. The refund will be processed to the Customer's bank account within 14 days from receiving the cancellation notice, provided the goods are returned to Horse and You's address at Kadakamarja tn 1, Saue, Harjumaa, Estonia.
7.4. The returned product must be complete (including all items that were originally included in the package, such as cables, etc.), unused, and the packaging must not be damaged. If the product was purchased as part of a promotion that included an additional item, the entire set must be returned in its original condition.
7.5. Horse and You reserves the right to charge the Customer for the return shipping costs and to deduct this amount from the refund.
7.6. If the returned product and/or its packaging is damaged, and the damage is not due to Horse and You, the company reserves the right to deduct the reduced value of the product from the refund amount. Horse and You will send a notice of the reduced value to the email address provided by the Customer during the order process. If the Customer disagrees with the value reduction stated in the notice, they have the right to engage an independent expert to assess the product’s reduced value. The costs of the expert evaluation will be split between the Customer and Horse and You, unless one party's position is deemed unjustified, in which case the costs will be borne by the party whose position was deemed unjustified.
8. Warranty and Return of Non-Conforming Products
8.1. Horse and You is responsible for product defects and non-conformities that appear within the warranty period.
8.2. Horse and You is not responsible for:
1) Damage or deterioration caused by the Customer or user;
2) Defects resulting from improper use of the product;
3) Normal wear and tear due to regular use.
8.3. If a product does not meet quality standards or has defects, the Customer has the right to request a replacement with a conforming product or withdraw from the order and return the defective product at Horse and You’s expense.
8.4. In the case of returning a non-conforming product, the full amount paid for the product (including shipping costs) will be refunded to the Customer’s specified bank account within 14 days of receiving the withdrawal request and the return of the product to Horse and You’s premises.
9. Liability and Force Majeure
9.1. Horse and You is not liable for any damages caused to the Customer or delays in product delivery if such damages or delays are due to circumstances beyond Horse and You’s control and which could not have been foreseen or prevented (force majeure).
10. Other Terms
10.1. Personal data obtained during visits to the Horse and You online store and purchases are treated as confidential and processed in accordance with Horse and You’s privacy policy. Customer data will not be shared with third parties, except for partners authorized to fulfill orders and Montonio Finance UAB for payment processing. The data controller is Horse and You OÜ.
10.2. Any matters not separately regulated in these terms shall be governed by the laws of the Republic of Estonia.
10.3. Disputes between the Customer and Horse and You shall be resolved through negotiations. If no agreement is reached, the parties have the right to contact the Consumer Disputes Committee under the Consumer Protection Board of Estonia, located at Pronksi 12, Tallinn 10117, phone: +372 6201920, email: avaldus@komisjon.ee, website: https://komisjon.ee/et, or take legal action in Harju County Court. For international consumer disputes, the European Union provides the Online Dispute Resolution (ODR) platform at http://ec.europa.eu/odr.
